Terms of Use

These Terms govern your use of Isle (the "App"), developed by Jacopo Giannetti ("we", "us"). By downloading or using the App you agree to them. They apply together with Apple's Licensed Application End User License Agreement; where the two differ, these Terms prevail to the extent permitted by Apple.

1. What Isle is

Isle helps you build good habits and quit unwanted ones by turning your progress into an island that grows over time. It is a motivational tool, nothing more.

2. Subscription

Some of Isle is free. After your first animal arrives, continuing to use Isle requires an auto-renewing subscription ("Isle Premium").

• The price and billing period are shown in the App before you buy. Payment is charged to your Apple Account when you confirm the purchase.
• If a free trial is offered, it turns into a paid subscription when it ends unless you cancel at least 24 hours before. Any unused part of a trial ends when you buy a subscription.
• The subscription renews automatically for the same period and price unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple Account is charged within 24 hours before the renewal.
• You can manage or cancel your subscription in Settings → Apple Account → Subscriptions. Cancelling stops future renewals; you keep access until the end of the period you paid for.
• Purchases are processed by Apple, and refunds are handled by Apple under its own policies at reportaproblem.apple.com.
• Deleting the App or its data does not cancel a subscription.
• If we change the price, Apple will notify you in advance as required by its rules, and where required you will be asked to agree to the new price.

3. Your islands

What you create in Isle is yours. It is stored on your device and, if iCloud is on, in your private iCloud, as described in the Privacy Policy. Syncing and backup depend on Apple's iCloud: we cannot recover islands that were never saved to iCloud, or that you deleted.

4. License and acceptable use

We grant you a personal, non-exclusive, non-transferable license to use the App on Apple devices you own or control, for non-commercial purposes. You agree not to copy, modify, distribute, sell or reverse engineer the App, except where the law allows it, and not to use it in a way that breaks the law or interferes with its operation.

The App, including its art, animals, worlds, text and code, belongs to Jacopo Giannetti and is protected by intellectual property laws. These Terms do not give you any rights to it other than the license above.

5. Changes to the App

We keep improving Isle, so features may be added, changed or removed. We may also stop offering the App. If we do, we will try to give reasonable notice, and your subscription can be cancelled through Apple as described above.

6. Disclaimer

We work hard to keep Isle reliable, but it is provided "as is" and "as available". To the extent permitted by law, we make no warranties that it will be uninterrupted, error-free, or suitable for a particular purpose, and we do not guarantee any result in changing your habits.

7. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for loss of data, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid for it in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or the rights you have as a consumer under the mandatory laws of the country where you live.

8. Termination

You can stop using Isle at any time by deleting it. We may suspend or end your license if you seriously breach these Terms. Sections 4 (ownership), 6, 7, 10 and 11 continue to apply after termination.

9. Copyright notices (DMCA)

We respect intellectual property rights. If you believe that something in Isle infringes your copyright, send a notice to legal@helloisle.app that includes: your physical or electronic signature; a description of the copyrighted work; a description of the material you believe is infringing and where it appears in the App; your contact information; a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on its behalf.

10. Apple

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App. Apple is not responsible for any claims by you or a third party relating to the App, including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims; we are responsible for those to the extent these Terms provide. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Governing law

These Terms are governed by Italian law. If you are a consumer, you also keep the protection of the mandatory consumer laws of the state where you live and may bring proceedings in its courts.

12. Changes to these Terms

We may update these Terms from time to time. If changes are significant, we will let you know in the App. The date at the top always reflects the current version, and continuing to use Isle after a change means you accept it.
